Sanepid (health authorities) imposed a 30,000 pln fine on Dawid Zmyślony, a restaurateur from Ostrów Wielkopolski for opening during the pandemic. The entrepreneur decided to pursue his rights in court. The Provincial Administrative Court in Poznań, at a closed session, overruled the decision of the Sanepid.
The Provincial Administrative Court in Poznań, at a closed session, overruled the decision of the Sanepid on the imposition of a penalty in the amount of PLN 30,000 PLN and awarded the costs of proceedings in the amount of PLN 4067 from the Wielkopolska State Provincial Sanitary Inspector in Poznań.
The event took place in January this year in the restaurant at ul. Wolności in Ostrów Wlkp. At that time, there was a lockdown in Poland. According to government guidelines, restaurants could only provide take-away services. Dawid Zmyślony from Ostrów Wlkp. did not adjust to the regulations. He explained to the health department employees who control him that the restaurant was filled with testers, not customers.
Sanepid from Ostrow visited Zmyślony’s restaurant twice. The first time it imposed a fine of PLN 30,000, the second – PLN 5,000. zloty. The restaurateur did not pay and applied to the court to revoke the decision.
